§ 1 Introductory Provisions

  1. The online store Summerhouse, available at the web address shopatsummerhouse.com, is operated by Klaudia Truszczyńska conducting business under the name Klaudia Truszczyńska, entered into the Central Register and Information on Economic Activity (CEIDG) kept by the minister responsible for economy, Tax Identification Number: 7441836263, National Business Registry Number: 527942926.

  2. These Regulations are addressed to both Consumers and Entrepreneurs using the Store and define the rules for using the Online Store and the rules and procedure for concluding Sales Agreements with the Customer at a distance through the Store.

§ 2 Definitions

  • Consumer – a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to their business or professional activity.

  • Seller – a natural person conducting business under the name Klaudia Truszczyńska, TIN 7441836263, Statistical ID 527942926.

  • Customer – any entity making purchases through the Store.

  • Entrepreneur – a natural person, a legal person, or an organizational unit without legal personality to which a separate law grants legal capacity, performing business activity in its own name, who uses the Store.

  • Store – the online store run by the Seller at shopatsummerhouse.com.

  • Distance Contract – a contract concluded with the Customer within an organized system of concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to the conclusion of the contract inclusive.

  • Regulations – these Store regulations.

  • Order – the Customer's declaration of intent submitted via the Order Form and aimed directly at concluding a Product Sales Agreement with the Seller.

  • Account – the customer's account in the Store; it collects data provided by the Customer and information about Orders placed by them.

  • Registration Form – a form available in the Store that allows for the creation of an Account.

  • Order Form – an interactive form available in the Store that allows for placing an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

  • Cart – an element of the Store's software in which the Products selected by the Customer for purchase are visible, and it is possible to determine and modify the Order data, in particular the quantity of products.

  • Product – a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.

  • Sales Agreement – a contract for the sale of a Product concluded between the Customer and the Seller via the Online Store. A Sales Agreement also includes—depending on the features of the Product—a contract for the provision of services and a contract for specific work.

§ 3 Contact with the Store

§ 4 Technical Requirements

To use the Store, including browsing the assortment and placing orders, the following are required:

  • A terminal device with access to the Internet and a web browser.

  • An active e-mail account.

  • Enabled support for cookies.

  • Installed FlashPlayer program.

§ 5 General Information

  1. To the fullest extent permitted by law, the Seller is not responsible for disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties, or incompatibility of the Online Store with the Customer's technical infrastructure.

  2. Browsing the Store's assortment does not require creating an Account. Placing orders is possible either after creating an Account or by providing necessary personal and address data without creating an Account.

  3. Prices in the Store are given in Euros (EUR) and are gross prices (including VAT).

  4. The final amount to be paid consists of the price for the Product and the delivery cost, which the Customer is informed about during the placement of the Order.

  5. In the case of an Agreement involving a subscription or services for an indefinite period, the final price is the total price including all payments for the billing period.

  6. If the nature of the subject of the Agreement does not allow for a prior calculation of the final price, information on the method of calculation will be provided in the Product description.

§ 6 Creating an Account in the Store

  1. To create an Account, you must fill out the Registration Form (Name, Surname, E-mail).

  2. Creating an Account is free of charge.

  3. Logging in is done via the login and password established in the Registration Form.

  4. The Customer may delete the Account at any time, without giving a reason and without incurring any fees, by sending a request to the Seller.

§ 7 Rules for Placing an Order

To place an order:

  1. Log in to the Store.

  2. Select the Product and click "Add to cart" (or equivalent).

  3. Click the "Order and pay" button and confirm the order via the link sent in the e-mail.

  4. Choose a payment method and pay within the specified period.

§ 8 Delivery and Payment Methods

  1. The Customer can use the following payment methods: Shopify Payments.

  2. Detailed information on acceptable payment methods is available on the Store's website.

§ 9 Execution of the Sales Agreement

  1. The Sales Agreement is concluded after the Customer places an Order via the Order Form.

  2. After placing the Order, the Seller immediately confirms its receipt and accepts it for execution via e-mail. The Agreement is concluded upon receipt of this e-mail by the Customer.

  3. If the Customer chooses payment by transfer, electronic payment, or payment card, they are obliged to make the payment within 3 calendar days from the conclusion of the Sales Agreement—otherwise, the order will be canceled.

§ 10 Right of Withdrawal from the Agreement

  1. A Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.

  2. The period begins from the delivery of the Product.

  3. In the case of multiple Products delivered separately, the period begins from the delivery of the last item.

  4. To exercise the right, the Consumer must submit a declaration of withdrawal to the Seller (via mail, or e-mail).

  5. Effects of withdrawal: The Agreement is considered void. The Seller shall return all payments (including delivery costs, except for additional costs of a non-standard delivery) within 14 days.

  6. The Seller may withhold the refund until the Product is returned or proof of shipment is provided.

  7. The Consumer bears the direct costs of returning the Product.

  8. Exceptions: The right of withdrawal does not apply to:

    • Non-prefabricated items made to the consumer's specifications.

    • Sealed goods that cannot be returned for health/hygiene reasons if opened after delivery.

    • Perishable goods.

    • Fully performed services (with prior consent).

    • Digital content not recorded on a tangible medium (if the performance began with consent).

§ 11 Complaints and Warranty

  1. The Sales Agreement covers new Products. The Seller is obliged to deliver items free of defects.

  2. In case of defects, the Customer has the right to a complaint based on warranty under the Civil Code.

  3. If the Customer is an Entrepreneur, the parties exclude liability under the warranty.

  4. Complaints should be submitted in writing or electronically. The Seller will respond within 14 days.

§ 12 Out-of-Court Dispute Resolution

  1. Consumers may use out-of-court methods for handling complaints and claims (e.g., Consumer Ombudsmen, Trade Inspection, or the UOKiK website).

  2. Permanent amicable consumer courts and mediation proceedings are available.

§ 13 Personal Data

  1. The Seller is the Administrator of personal data.

  2. Data is collected to execute the Sales Agreement and, with consent, for marketing.

  3. Data may be shared with carriers (couriers) and payment operators.

  4. The Customer has the right to access and correct their data. Providing data is voluntary but necessary to conclude the Agreement.

§ 14 Final Provisions

  1. Contracts are concluded in English.

  2. The Seller reserves the right to change the Regulations for important reasons (law changes, payment/delivery changes) with 7 days' notice.

  3. In matters not regulated, Polish law applies (Civil Code, Consumer Rights Act, etc.).
